1. Acceptance of Terms
By accessing or using our website, marketing services, or any related tools (“Services”), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you may not access or use our Services.
2. Scope of Services
Mortgage Marketing Authority provides digital marketing and advertising services, including but not limited to:
Lead generation through paid ads (Google, Meta, etc.)
Social media marketing
Video ad creation
Landing page design and CRM integration
We are not a mortgage lender, loan originator, or financial institution. All leads, campaigns, and materials are created for marketing purposes only.
3. Client Responsibilities
Clients agree to:
Provide accurate and lawful business information.
Maintain compliance with all federal, state, and local advertising and mortgage regulations (including RESPA, TILA, and CFPB rules).
Use leads and marketing materials ethically and legally.
Provide timely feedback, approvals, and access to required platforms.
The Company is not responsible for compliance violations resulting from client misuse of advertising materials, data, or leads.
4. Payments and Fees
All fees for Services are due as outlined in the applicable agreement or invoice.
Payments must be made on or before the due date.
Late payments may result in suspension or termination of services.
All payments are non-refundable, unless otherwise specified in writing.
Marketing ad spend paid to third-party platforms (e.g., Google, Meta) is the client’s responsibility.
5. Results
While we aim to improve your marketing performance, we make no guarantee of specific results such as lead volume, conversion rate, or return on investment. Marketing outcomes depend on various factors beyond our control, including market conditions, client response time, and ad performance.
6. Intellectual Property
All content, materials, graphics, ad creatives, and strategies produced by the Company remain the intellectual property of Mortgage Marketing Authority unless otherwise stated in writing.
Clients are granted a limited license to use materials solely for their business during active engagement.
7. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of business. This includes business data, leads, customer lists, and marketing strategies.
8. Limitation of Liability
To the maximum extent permitted by law, Mortgage Marketing Authority shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to our Services, including loss of revenue, profits, or data.
Our total liability, if any, shall not exceed the total amount paid by the client for Services within the last 30 days.
9. Indemnification
The client agrees to indemnify and hold harmless Mortgage Marketing Authority, its owners, employees, and affiliates from any claims, damages, losses, or liabilities arising out of:
The client’s use of leads or marketing materials;
The client’s violation of any law or regulation;
Any breach of these Terms.
10. Termination
Either party may terminate the agreement with written notice. The client remains responsible for payment of all work completed prior to termination. Any prepaid fees are non-refundable.
11. Governing Law
These Terms and any related agreements shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action shall be brought in the appropriate courts of Orange County, California.
12. Changes to Terms
Mortgage Marketing Authority reserves the right to update or modify these Terms at any time. Updates will be posted on our website with a new effective date.
